KYBA/OBA Waiver


I understand that by registering with Kanata Youth Basketball Association (KYBA), I am also registering to become a member of the Ontario Basketball Association (OBA), to which KYBA is an affiliated member club.  I hereby agree, in return for becoming a member of the KYBA and OBA:
   TO RELEASE THE KYBA, THE OBA, event organization bodies, sanctioning bodies and OBA sponsors and their respective directors, officers, employees, agents, volunteers, contractors, representatives, successors or assigns (collectively the “Releasees”) from any liability for any loss, damage, injury or expense (collectively “Loss”) that I may suffer as a result of my participation in and transportation to or from any KYBA or OBA program, due to any cause, including negligence or breach of contract;
   TO WAIVE ANY CLAIM that I have or may have against any or all of the Releasees regarding any matter, including without limitation, any claim arising out of any KYBA or OBA program;
   TO INDEMNIFY THE RELEASEES from any and all claims, actions or Loss resulting in any way from my participation or participation of the child named above in any KYBA or OBA program;
   THIS DOCUMENT SHALL bind my heirs, executors, administrators, assigns and representatives and will have effect throughout my membership in the KYBA and OBA and, to the extent reasonably necessary to give it effect, thereafter;
   THAT I am (or the child named above is) physically fit to participate in any KYBA or OBA programs; I am a legal guardian or custodial parent of the child named above.
   THAT the KYBA and OBA is authorized to take photos of the child named above or me at its programs for publicity and promotional purposes only.
I hereby acknowledge and agree that KYBA and OBA may use and disclose the information on this form to enable KYBA or OBA to provide membership benefits to all KYBA and OBA members.
I HAVE READ AND UNDERSTAND THIS AGREEMENT. By submitting this application, I acknowledge having read, understood and agree to the above Waiver, Release and Indemnity.  I further agree to conduct myself in accordance with the ‘Guidelines for Behavior’ at OBA Sanctioned Events.

#consent# I hereby acknowledge that I understand the risks inherent in playing basketball and will not hold the Kanata Youth Basketball Association, event organization bodies, sanctioning bodies and sponsors and their respective directors, officers, employees and agents, responsible for any injuries, loss, damage or expense sustained while participating in programs, practices or other events. 

Covid-19 Policies


Release of Liability and Assumption of Risk Waiver Specific to COVID-19
 
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact.  As a result, Health Canada, the province of Ontario and the City of Ottawa Public Health Agencies have put protocols and recommendations in place to minimize the transmission of COVID-19.  KYBA operates in compliance with Health guidelines and has put in place recommended preventative measures to reduce the spread of COVID-19;
However, KYBA cannot guarantee that you or your child(ren) will not become infected with COVID-19 through the participation in any KYBA Programs.
 
By signing this agreement, I acknowledge the contagious nature of COVID-19, and other illnesses and viruses, and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19, or any other virus, by attending KYBA and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 and other contagious diseases and viruses may result from the actions, omissions, or negligence of myself and others, including, but not limited to, directors, coaches, volunteers, independent contractors, Program participants and their families.  I hereby release and forever discharge KYBA and their directors, coaches, independent contractors, staff, members, volunteers, representatives, and assigns, from liability for harm, injury or death pertaining to COVID-19 and other contagious diseases and viruses., staff, Program participants and their families.  I hereby release and forever discharge
 
Covid-19 Declaration of Compliance

By acknowledging the following, the Participant (named above and provided by Participant Guardian for minors) and Participant Guardian (named above) provide declaration of compliance to the following guidelines to minimize the risk of transmission of Covid-19 at KYBA and in all KYBA sponsored Programs. 
This declaration is required and implied for EACH and EVERY date for which Participant attends the Program being registered for on this form with KYBA.
1. Has not travelled internationally during the last 14 days;
2. Has not visited a COVID-19 high-risk area, region or location in Canada during the last 14 days;
3. Does not knowingly have COVID-19;
4. Is not experiencing known symptoms of COVID-19, such as fever, cough, shortness of breath, loss of smell and/or taste and if experiences such symptoms during the Program will immediately depart from the Program;
5. Has not, in the past 14 days, knowingly come into contact with someone who has COVID-19, who has known symptoms of COVID-19, or is self-quarantining after returning to Canada; and
6. Follows government recommended guidelines in respect of COVID-19, including practicing physical distancing and wearing a mask, and will do so to the best of the Participant’s ability during the Program.


Withdrawal and Refund Policies
 

For KYBA House League programs (Novice, Atom, Bantam, Midget, Juvenile)

KYBA will grant a full refund, less a $25 administration fee, for all withdrawal requests received by October 1.
 
KYBA will grant a 50% refund, less a $25 administration fee, for all withdrawal requests received between October 2 and November 30.

No refunds will be granted after November 30.

All withdrawal requests must be submitted to the KYBA Administrator by a listed parent or guardian on the players registration record/player profile.  Refunds issued are processed back to the original form of payment.

For KYBA Tykes Sessions
 
KYBA provides a 14 day grace period from the start of any Tykes session to request a full refund, less a $25 administration fee.  All withdrawal requests must be submitted to the KYBA Administrator by a listed parent or guardian on the players registration record/player profile.  Refunds issued are processed back to the original form of payment.
 
For Ottawa Next Level Competitive Program
 
Competitive registration fees are non-refundable regardless of the time of withdrawal.

For Selects, Spring, Summer, Skill Sessions, Tryouts, ONL Academy and Pre-Season Programs

Registration fees are non-refundable regardless of time of withdrawal for all tryouts, Spring, Summer, pre-season programs, and skill sessions.

For ONL Summer Camp

Any refund requests received in writing by the KYBA Administrator before June 1 of the Camp year will be granted a full refund, less a $50 administration fee. 
No refunds will be issued after June 1.  All withdrawal requests rmust be submitted to the KYBA Administrator by a listed parent or guardian on the players registration record/player profile.  Refunds issued are processed back to the original form of payment.


KYBA Members Code of Conduct

All KYBA Members - players, parents and coaches are expected to abide by the appropriate code of conduct.  All members shall remain respectful towards others - teammates, coaches, volunteers, junior referees, Board Officials and other members or spectators, facilities and facility staff at all times.  

Parents’ and Spectators’ Behavioural Guidelines
Definition:
All parents, legal guardians and other spectators are responsible for proper conduct (their own and that of their guests) while attending or participating in all KYBA activities no matter the role they have in the event.
Goal Statement:
Anyone participating in amu KYBA sanctioned event (practice, game, skill session, tryout, or any other event) will be expected to adhere to the following Guidelines for Behavior supporting Ontario’s Basketball Fair Play Policy.
Actions:
Parents/Legal guardians should always model mature behaviour consistent with the goals of the Ontario’s Basketball Guidelines for Behaviour supporting Ontario’s Basketball Fair Play Policy:
a) Remember that your son/daughter participates in basketball for his/her enjoyment, not your own.
b) Encourage him/her to participate, do not force him/her.
c) Focus on his/her effort and performance rather winning or losing.
d) Never ridicule or yell at your son/daughter or any other youth player for making a mistake or losing a competition.
e) Encourage your son/daughter to play according to the rules of the event.
f) Appreciate good performances and skillful plays by your son/daughter and all the other participants.
g) Support all efforts to remove verbal and physical abuse from youth sporting activities.
h) Respect the officials’ decisions and teach your son/daughter to do likewise.
i) Respect the rights, dignity and worth of every young participant.
Failure to adhere to these guidelines may result in removal from the gym facility and/or disciplinary action in accordance with established OBA Disciplinary Policies.

Privacy Policy

KYBA registration system maintains a comprehensive database of all players registered in the current and previous seasons. In addition to standard information such as name, address, phone number(s) and birth date, the registration system stores the name and phone number of an emergency contact, fee payment details and status, descriptions of player health problems, player team requests and assignment, and a fifteen (15) year history of team and coach for each player.

Player health information provided by parents on the registration form is provided to coaches and division conveners for the sole purpose of ensuring the maximum level of safety possible for the child during games and practices. Financial information beyond the indication that the player has or has not paid his / her fees, is handled exclusively by the KYBA Administrator and is not shown on any forms, printouts or documents outside the registration system. Communication of financial matters (e.g. fee payments) is by email or physical mail directly from the KYBA Administrator to the concerned parent.

The information in the registration system is for the exclusive use of KYBA and is used solely for the purpose of administering KYBA programs. KYBA will not provide any player information to anyone outside the Executive and coaches. Coaches are required to destroy all player information other than team player lists and personal notes at the end of each season.

A printout of the player information record for any registered player is available to a player’s parent or legal guardian upon receipt of a written (signed) request to the KYBA Registrar. Juvenile and Junior division players who are 18 years-of-age may acquire a printout of their player information and history records upon receipt of a written (signed) request to the KYBA Registrar. Please understand that under the Canada’s privacy statutes, the KYBA cannot provide parents of adult players with their child’s player information or history records.
